Fencing Your Montana Property
Most of Montana is classified as open range, which means that the property owner is responsible for fencing neighboring livestock out. This rule affects a surprising number of residential property owners that live in rural subdivisions that are next to open-range areas. It is the residential property owner’s responsibility to fence their property boundary if they don’t want livestock from the open range wandering onto their property.
Montana property line and fence laws are well established and will resolve most issues and I encourage you to learn more. The most common issue can be where the responsibility falls in maintaining a shared fence.
Montana does not allow “Spite Fences” so do play nice with your neighbors!
